We all have a responsibility to pay the federal government taxes each year but there are individuals and companies that do not believe this refers to them. This is of course against the law and a person of company found attempting this act is committing a crime. Perpetrators can be punished severely for this type of offence as it can have serious consequences on the running of government. While these are often referred to as 'white collar' crimes that does not make them more respectable even if the majority of them are committed by 'clean' citizens usually with no previous record.

There are types of tax fraud and degrees of seriousness with tax evasion the most important but it can also refer to the small business that is just late in filing their tax report for the financial year. Despite the serious nature of tax fraud, it is not always the fault of the person being investigated as ignorance of the laws can be to blame. It is also not unusual for people and companies to fall victim to the poor advice of tax consultants.

Often attorneys will provide proof that their client was the unwilling victim of tax fraud and although still guilty it is usual for the punishment in these circumstances to be more lenient or the charges dropped completely. It is very important to select tax consultants carefully as only those with proper industry certifications and detailed exposure to such cases can help people solve what can be tricky situations with the IRS.

The normal approach by a tax fraud lawyer will be too reason the argument that prosecuting the individual or company will not serve the public interest as recovery of the taxes owed is less likely. The authorities ultimately want the tax liability to be paid so a good tax attorney will pursue the option of regular tax payments instead of prosecution and a custodial order.
